- The legal requirement is that driver cards must be download at least once every 28 days. However, current advice is that operators should aim to do this more frequently with an interval of once a week most often quoted. With the advance of remote downloading, many operators have access to card data on a daily basis with some opting to follow suite even through manual downloading devices.
- It is a similar picture when it comes to Vehicle Unit (VU) data; legally, this must be downloaded at least every 90 days but best practice is to do it more often. When downloading manually, a frequency of 28 days is recommended with remote download systems providing data weekly or sometimes even daily.
- The move towards more frequent downloading has been driven by the OTC and other enforcement authorities as a means of more effectively capturing and comparing card and vehicle data so any issues can be jumped on in a more timely fashion.
- UK operators are required to retain tachograph records for at least 12 months for the purpose of enforcing Drivers’ Hours.
- However, as most operators will use tachograph data to form the back-bone of their drivers’ RTD (Working Time) records, data needs to be kept for 24 months so this has become somewhat of a standard retention period.
- Many operations with choose to retain data for longer periods (typically 2–7 years) to support employment disputes, investigations, audits, and internal reporting but this will need to be arranged with the analysis provider to ensure all GDPR requirements are met.
- Missing a scheduled download can lead to gaps in your records, making it difficult to demonstrate compliance during an inspection. Consideration also needs to be given to capturing data from transient drivers such as agency staff who can often operate out-of-hours and are not subject to the same induction and debriefing processes that are applied to full-time staff.
- Gaps in tachograph data can increase the risk of enforcement action if the data cannot be produced when requested by authorities. A clear downloading procedure should be laid out and an operator should be able to produce evidence that it is being followed.
- Making use of an analysis system’s automated alerts can help prevent missed download and assist with regular monitoring.
- Increasingly, operators are making use of remote download technology to make tachograph downloading more efficient. Downloading your driver cards and vehicles remotely saves time, reduces vehicle downtime, and helps ensure data is collected on schedule without requiring the vehicle to return to base.
- Remote downloading systems can now come from a number of different sources: many vehicle manufacturers will supply new vehicles with the technology built in; many tracking and telematics providers can also offer remote downloading as an addition service; after-market devices can also be fitted by other suppliers such as tachograph analysis providers.
- Each operation needs to have a clearly-defined debriefing procedure in the event that drivers commit offences under Drivers’ Hours or RTD (Working Time). This procedure should be agreed with the driver upon employment so they are fully aware of expectations and consequences.
- Once an infringement has been identifies, speak with the driver and document any mitigating circumstances.
- Provide additional driver training where necessary and ensure evidence has been documented.
- Record the corrective actions taken and monitor for repeat offences.
- Regular analysis demonstrates that your business is actively managing compliance, which is viewed positively by enforcement authorities.
