Terms & Conditions

1. Definitions

  • Buyer: the person or organisation who buys or agrees to buy the goods from the Seller.
  • Conditions: the terms and conditions of sale as set out in this document and any special terms and conditions agreed in writing by the Seller.
  • Goods: the articles which the Buyer agrees to buy from the Seller.
  • Price: the price for the Goods, excluding VAT and any carriage, packaging and insurance costs.
  • Seller: Aquarius IT Ltd, registered at 26 The Green, Kings Norton, Birmingham, B38 8SD


2. Conditions

 

2.1 These “Terms and Conditions” do not affect your statutory rights as a consumer.

2.2 All contracts of sale made by the Seller shall be deemed to incorporate these terms and conditions which shall prevail over any other document or communication from the Buyer.

2.3 No variation to the Order or these Terms is binding unless agreed in writing between authorised representatives of you and us.

2.4 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods from the Seller pursuant to these Conditions.

2.5 Acceptance of delivery of the Goods shall be deemed to be conclusive evidence of the Buyer’s acceptance of these Conditions.

3. Price


3.1 The Price shall be the amount shown, appropriate to the quantity ordered, as on the website shopping cart or on the quotation.

3.2 All Prices are exclusive of VAT and charges for packing, postage and carriage (plus VAT) which shall be paid in addition at the appropriate rate.


4. Payment Terms

 

All Buyers shall pay in full for all Goods ordered on-line prior to their despatch, if applicable, including carriage at the appropriate rate. Only electronic payments are accepted, no cheques.


5. Goods


5.1 The quantity and description of the Goods supplied shall be as set out in the details completed by the Buyer either on the website or as received by telephone.

5.2 Aquarius IT Ltd reserves the right to discontinue lines without notice and from time to time some products shown may vary slightly from those received but their purpose will remain the same.

5.3 While every effort is made to ensure that the product specifications on our web site are accurate, manufacturers do add and remove functionality in their products. There may be a delay before the product descriptions are updated reflecting these changes.


6. Warranties

 

6.1 The Seller warrants that the Goods will at the time of delivery correspond to the description given by the Seller. Except where the Buyer is dealing as a consumer (as defined in section 12 of the Unfair Contract Terms Act 1977), all other warranties, conditions or terms relating to fitness for purpose, quality or condition of the Goods are excluded.

6.2 The buyer must inspect any Goods on delivery and notify the Seller within 48 hours of delivery of any alleged failure to conform with the specification as set out on the website. Provided that we have not received such a notification within the 48 hours, acceptance of the Goods and a conclusive presumption that the quantity of Goods matches the order specification will be deemed to have occurred.

7. Delivery of the Goods


7.1 Delivery of the Goods shall be made to the nominated Buyer’s address by our nominated carrier. The Buyer shall make arrangements to take delivery of the Goods on the expected day as notified by the Seller for delivery.

7.2 The Seller undertakes to use its reasonable endeavours to despatch the Goods on the day of the order, if received before 2.00pm. but does not guarantee to do so.

7.3 We advise two to three working days for delivery. However, this is not guaranteed, therefore allow up to five working days. Please ensure you contact us, if your order has not been received within 14 days of order confirmation. You will be advised if your item is out of stock, as this will affect delivery times.

7.4 The Seller shall not be liable to the Buyer for any loss or damage whether arising directly or indirectly from the late delivery or short delivery of the Goods. If short delivery does take place, the Buyer undertakes not to reject the Goods but to accept the Goods delivered as part performance of the contract.

7.5 If the Seller fails to deliver the Goods for any reason other than any cause beyond the Seller’s reasonable control or the Buyer’s fault, and the Seller is accordingly liable to the Buyer, the Seller’s liability shall be limited to the excess (if any) of the cost to the Buyer (in the cheapest available market) of similar goods to replace those not delivered over the price of the Goods.

7.6 If you fail to take delivery of the Goods at the Delivery Time or fail to give us adequate instructions for delivery then without prejudice to our other rights or remedies, we may at our option either store the Goods until delivery and charge you reasonable costs for storage and repeated delivery or sell the Goods to a new buyer and charge you for any shortfall below the Price (taking into account any additional delivery or storage costs).

7.7 We may deliver the Goods in instalments but in such circumstances the contract will still be a single contract and not severable.

8. Acceptance of the Goods


8.1 The Buyer shall carry out a thorough inspection of the Goods within 48 hours of delivery and shall give written notification to the Seller ideally by email to info@aquariusit.com within 48 hours of delivery of the Goods of any defects which a reasonable examination would have revealed.

8.2 Where the Buyer has accepted, or has been deemed to have accepted, the Goods the Buyer shall not be entitled to reject Goods which are not in accordance with the contract.


9. Ownership & Risk


9.1 The risk in Goods shall pass to the Buyer upon delivery of the Goods or upon the Goods being appropriated to the Buyer but kept at the Seller’s premises at the Buyer’s request.

9.2 The Seller remains the owner of the Goods affected by the Contract until the Seller has been paid in full for such Goods.

9.3 Any Goods in respect of which any claim of defect or damage is made shall be preserved by the Buyer intact together with the original packing at the Buyer’s risk and either: a) retained by the Buyer until the Seller or its agent is able to inspect or Collect the Goods or b) at the Seller’s option returned by the Buyer to the Seller who will refund the cost of postage and packing to the Buyer if the Goods are in fact defective.


10. Charges for Carriage of Goods


Carriage will be chargeable at the current rate of £7.50 per order for standard UK deliveries on orders over £50 product value and £5.50 per order for standard UK deliveries on orders under £50. However, carriage charges for any orders outside of the UK, Northern Ireland or the Scottish Highlands, regardless of value, are subject to separate delivery charges, based on location, weight, size and value of goods – for further information please contact info@aquariusit.com


11. Returns


If you bought products and decide that you no longer require them, you can return them to us, at your expense, within 14 days of delivery for a full refund, if the products are undamaged, unopened and unused, all parts are returned, and the item remains suitable for resale at the time of receipt by the Seller.


12. Faulty Products


If any goods are found to be faulty, please contact us at info@aquariusit.com to register the issue, return the goods to us and, if after inspection the goods are found to be faulty, we will either arrange for a repair or send you a replacement free of charge if the item is still within their warranty period.
